Doctors cannot sue over Biden admin’s transgender health discrimination policy, court rules

Two Texas doctors did not have standing to sue the Biden administration over a 2021 policy statement that federal law bans discrimination in healthcare against transgender people, a federal appeals court has ruled. A unanimous three-judge panel of the New Orleans-based 5th U.S. Circuit Court of Appeals on Monday found that the doctors did not have legal standing to bring the case because they did not violate the policy or face any threat of enforcement, reversing a ruling in their favor by U.S. District Judge Matthew Kacsmaryk in Amarillo, Texas. Jonathan Mitchell, a lawyer for the doctors who once served as Texas solicitor general and helped craft an anti-abortion law in that state, did not immediately respond to a request for comment. Nor did the U.S. Department of Health and Human Services, which issued the policy.
